Terms of Service

1. Acceptance of Terms

By accessing or using DevIntern's website, tools, or services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Services.

2. Description of Services

DevIntern provides AI-powered developer tools, including @devintern/code (automated Jira task implementation) and @devintern/pm (engineering spec generation). Services are delivered via downloadable tools and this website for license management and account access.

3. Licenses

The Software is licensed, not sold, under the Functional Source License, Version 1.1, Apache 2.0 Future License ("FSL-1.1-Apache-2.0"), the full text of which is included with the Software distribution. Interactive use of the Software, meaning you run it yourself from your own terminal, is a Permitted Purpose under the FSL and is free forever, with no license key or purchase required. Two years after we first publish a given version of the Software, that version additionally becomes available to you under the Apache License, Version 2.0, as set out in the FSL's Grant of Future License.

Automation License: Unattended or automated execution of the Software, such as via CI, cron, systemd, or webhook-triggered workflows, requires a separate automation license in addition to the FSL grant above. Automation licenses are sold as:

Supporter License: A one-time purchase granting unattended automation for one named individual's own repositories.

Team License / Business License: A recurring subscription (billed monthly or annually) granting unattended automation for your organization, scoped to the developer limits of the purchased tier.

4. Account and Authentication

You may need to create an account to purchase licenses or access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We use Supabase for authentication and account management.

5. Payments

All prices are in USD. The Supporter License is a one-time purchase and, once purchased, continues to grant automation rights for the version(s) it covers. Team and Business licenses are subscriptions billed monthly or annually that renew automatically until cancelled; access to unattended automation ends at the close of the then-current billing period after cancellation. Team and Business subscriptions include a 30-day money-back guarantee: contact us within 30 days of your first purchase for a full refund. Other purchases are final, except where applicable law requires otherwise.

6. Restrictions

You may not:

  • Distribute, sublicense, rent, lease, lend, sell, or otherwise transfer the Software to any third party.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code, except as permitted by applicable law.
  • Remove or alter any proprietary notices or labels on the Software.
  • Use the Software to provide a service bureau, time-sharing, or similar service to third parties.
  • Circumvent or disable any license key, activation, or technical protection measures.
  • Run the Software for unattended or automated execution (CI, cron, systemd, webhooks, or similar) without a valid Supporter, Team, or Business automation license.
  • Exceed the developer limits of your purchased Team or Business license.

7. Intellectual Property

The Software and all related materials are the exclusive property of Daniil Pokrovsky, operating as devintern.com. All rights, title, and interest in and to the Software, including all intellectual property rights, are retained by the Licensor. This Agreement does not grant you any rights to trademarks, service marks, or logos.

The Software's source code is available to all users under the FSL-1.1-Apache-2.0 license described in Section 3; no separate source-access agreement is required.

8. Disclaimer of Warranty

THE SERVICES AND SOFTWARE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

9. Limitation of Liability

IN NO EVENT SHALL DEVINTERN OR DANIIL POKROVSKY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SERVICES OR SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination

The Supporter License's automation rights are perpetual for the version(s) purchased. Team and Business automation licenses remain active only for the duration of the then-current subscription period. We may terminate your access to the Services immediately if you fail to comply with these terms. Upon termination, you must cease all use of the Software beyond the Permitted Purposes described in Section 3 and destroy all copies obtained solely through a terminated automation license. Provisions that by their nature should survive termination shall survive.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Services after any changes constitutes acceptance of the revised terms.

12. Disputes

Payment and billing disputes are handled in accordance with the terms of our payment processor, Polar. For all other disputes arising from these Terms or your use of the Services, the parties agree to first attempt to resolve the matter through good-faith direct communication. If a dispute cannot be resolved informally, either party may pursue resolution through the competent courts at the Licensor's place of business.
